Terms of Agreement for online trading between Barkos Pty Ltd (ABN 45065336792) Trading as CODE LOVE (CODE LOVE) and The user of this website (“You/Your”)
Please read them carefully before proceeding with entering the Website. You must accept these terms and conditions to access this Website any further.
ORDERS AND PAYMENTS By completing a Purchase Order, You are making an offer to purchase the Product at the price set out in the Website. Payment must be made at the time of submitting the Purchase Order. Payment can be made by PayPal or credit card payments through PayPal if a PayPal account is not owned. You warrant that You are an authorised user of the credit card or PayPal account used to complete payment. All Purchase Orders placed through this Website are subject to confirmation and acceptance by CODE LOVE. We will email you with confirmation of the receipt of Your Purchase Order. CODE LOVE may reject Your Purchase Order, and refund any payment made by You, at any time prior to dispatch. The Purchase Order must be paid in full immediately upon entry into the Agreement. All transactions are settled in Australian Dollars (AUD).
CODE LOVE may vary prices in the event of price changes or mistakes on this Website without prior notice to You. If CODE LOVE requests payment for increased prices, You may cancel the order. Notification of your wish to cancel the order in these circumstances must be received within seven days of the announcement of the increase. CODE LOVE reserves the right to limit the quantities of product sold as it sees fit. It is a condition of this Agreement that you do not resell the Products to a third party. CODE LOVE does not permit the purchase of items for resale. Customers wishing to be a stockist of CODE LOVE products must contact CODE LOVE directly, where they will be informed of the options available to buy higher quantities.
This Website is owned and operated by CODE LOVE. This Agreement supersedes all prior agreements and may be revised by CODE LOVE from time to time.
USING THE WEBSITE You agree that You will use this Website in accordance with these terms and conditions and that You will not use this Website for any unlawful purpose. You will not violate or attempt to violate the security of this Website. You will not hack into this Website, CODE LOVE computer systems or the computer systems of other users of this Website. Hacking means unauthorised access, malicious damage and/or interference and includes, without limitation, mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks or any other method designed to damage or interfere with the operation of a computer system or website.
ACKNOWLEDGEMENT All CODE LOVE products are hand made. You acknowledge that the Products require special maintenance as outlined in our care instructions included with the product. CODE LOVE will not be liable for any damage caused by any failure by You to maintain the Product properly. Please note that the colours and shapes of Product may vary slightly from those displayed by Your computer monitor.
Please note that the Trade Practices Act 1974 and similar State and Territory legislation in Australia may confer rights and remedies on you which cannot be excluded, restricted or modified (“Non-excludable Rights”). Notwithstanding any other term in this Agreement, CODE LOVE does not exclude any Non-excludable Rights but does exclude all other conditions and warranties, whether implied by custom, law or statute.
RETURNS, DAMAGED OR FAULTY PRODUCTS
If You wish to return a faulty or damaged Product, CODE LOVE will gladly repair, exchange or refund the original piece in accordance with the following process:
- That the Product was purchased within 1 month of faulty date.
- You must notify CODE LOVE by email info@codelove.com.au to obtain a “Return’s number”.
- You must provide a “proof of purchase”, being either an invoice, bank statement, email confirmation from CODE LOVE or delivery note.
- You must return the Product to CODE LOVE head office.
- On International returns You must mark on the courier company’s consignment so that the Products do not attract possible customs duties and taxes again.
- CODE LOVE will then refund the Price to You in full, replace the Product or exchange for a different Product.
- Refunds can only be credited back to the Pay Pal account or credit card that was used to make the original purchase. The refund will be processed as soon as the items have been received by CODE LOVE, however, please allow up to 2 weeks from the day You return the Product for Your account to be credited.
- Exchanges of faulty product are only possible if the item is available. CODE LOVE can only exchange faulty items for the same item in the same style, subject to availability. If You wish to exchange, please make Your request clear when requesting Your Return ID number.
- Please note that unfortunately, returns may not be made to a CODE LOVE stockist.
ACCEPTANCE OF TERMS
By entering this website you agree to these terms and conditions. From time to time, this Agreement will be reviewed and may be revised. CODE LOVE reserves the right to change this Agreement at any time. Any such changes will be posted on this Website.
WEBSITE DOWN-TIME
From time to time down-time, either scheduled or unscheduled, may occur. CODE LOVE will work within reason to ensure the amount of down-time is limited. CODE LOVE will not be held liable for the consequences of any down-time.
INTELLECTUAL PROPERTY
Reproduction of part or all of the contents in any form of this Website is prohibited other than for individual use only and may not be recopied and shared with a third party. The permission to recopy by an individual does not allow for incorporation of material or any part of it in any work or publication, whether in hard copy, electronic, or any other form. Unless otherwise noted, all materials on this Website are protected as the copyright, trade dress, trademarks and/or other intellectual properties owned by CODE LOVE or by other parties that have licensed their material to CODE LOVE. The display of these marks and of notices associated with these marks in not intended to be a comprehensive compilation of all worldwide proprietary ownership rights held by CODE LOVE.
